JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-02-2018 After some argument, learned counsel for the petitioner seeks to withdraw the present petition as far as the petitioner no.1 is concerned.
Accordingly, the present petition as far as petitioner no.1 is concerned is dismissed as withdrawn.
Now coming to the merits of the case, it is the case of the prosecution that the accused persons have killed the victim lady on account of non-fulfillment of the demand for dowry. The learned counsel for the petitioner submits that as far as petitioner no.2 is concerned, she is the mother-in-law of the victim lady and no specific allegation whatsoever has been levelled as against her. It is further submitted that the petitioner

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner no.2 herein to the privilege of anticipatory bail, in t he even of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.14, Motihari, East Champaran in connection with Sangrampur P.S. Case No.121 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
