JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Mehus P.S. Case No. 2 of 2017 registered for the offence punishable under section 30(a) (c) of the Bihar Prohibition and Excise Act, 2016 and section 47(A) of the Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been implicated in this case merely on basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized materials. He has been named by the village Chowkidar on account of dirty village politics. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.9328 of 2018(2) dt.20-02-2018 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Juxdge, Sheikhpura in connection with Mehus P.S. Case No. 2 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
