The petitioner apprehends his arrest in Masaurhi P.S. Case No.490 of 2019, corresponding to Special Case No.70 of 2019, registered under Sections 20 and 22 of the N.D.P.S. Act. The informant got secret information that the petitioner was indulged in trade of Ganja. After having received such information, the informant with other police officials raided the house of the petitioner along with the Magistrate but the petitioner managed to flee away. Other family members of the house of the petitioner also managed to flee away. On search, from the bed of the house of the petitioner, purias containing Ganja weighing about 150 gms. were recovered. The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. Nobody has
Patna High Court CR. MISC. No.83948 of 2019(8) dt.10-07-2020 2/2 seen the petitioner selling Ganja but it appears that petitioner has got criminal antecedent and he was accused in Masaurhi P.S. Case No.301 of 2016 registered under Sections 20 and 22 of N.D.P.S. Act for the recovery of 50 gms. of Ganja from the possession of the petitioner. The informant got definite information that it was petitioner who was selling Ganja and on such information, 150 gms. of Ganja kept in purias were recovered from the bed of the house of the petitioner. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
