The petitioners apprehend their arrest in Shikarpur P.S. case No. 51 of 2017 under Section 406, 420 of the Indian Penal Code.
The informant alleged that both these petitioners came to his house and requested the informant to take the land fell in the share of their mother and Fua. The petitioners demanded money and it is alleged that informant gave Rs. 3,50,000/- through cheque in the name of mother of petitioners and Rs. 10, 000/- cash to Urmila Devi, Fua of petitioners, but they did not execute the sale deed.
Patna High Court Cr.Misc. No.17515 of 2018 (2) dt.05-04-2018 2/2 The learned counsel for the petitioners submits that petitioners have no manner of concern and they have falsely been implicated in the case. The informant earlier purchased the land from father of the petitioners and for that he issued cheque in the name of mother of petitioners and taking advantage of this fact the informant lodged the case making false and frivolous allegation. Considering the facts that the dispute relates to non performance of oral contract, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur P.S. case No. 51 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
