JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

Petitioner is not named in the first information report and it appears from perusal of impugned order that the petitioner was arrested in Khajekala P. S. Case No. 169 of 2019 and after that he was remanded in the present case.

Submission on behalf of the petitioner is that no stolen article of the present case was recovered from his conscious possession and as a matter of fact, he was arrested in Khajekala P. S. Case No. 169 of 2019 and he was remanded in

Patna High Court CR. MISC. No.67478 of 2019(2) dt.04-11-2019 2/2 several cases which had been lodged against unknown persons. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur in connection with Rupaspur P. S. Case No. 125 of 2019.
