Learned counsel for the petitioner submits that the petitioner is holding the post of Superintendent of Police but, he has been deprived of his promotion as a Staff Officer. In view of the Central Administrative Tribunal Act, 1985, after being member of the Indian Police Service, he will be governed by the provision of the aforesaid Act and the Administrative Tribunal will be the only proper forum where the petitioner will be able to raise his grievance.

Patna High Court CWJC No.6458 of 2017 dt.31-08-2018 2/2 In such view of the matter, the petitioner is permitted to withdraw this writ petition with a liberty to approach to the Central Administrative Tribunal for redressal of his grievance. With the aforementioned observation and liberty, this writ petition is dismissed as withdrawn.
