Petitioner apprehends his arrest in connection with Hajipur Nagar P. S. case no. 707/2017 registered under sections 188, 379/34 of the IPC and sections 4, 40(1) (8), 49 of the Bihar Minor Mineral Concessions Rules, 1972 and Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.

18 trucks over loaded with Sone sands were seized. Petitioner happens to be one of the drivers of the said truck. However, it is informed that co-accused Upendra Rai and Sonu Kumar Rai, having similar allegation have already been granted privilege of bail by different benches of this

Accordingly, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Nagar P. S. case no. 707/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
