2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.
3. The case of the prosecution is that on 30.05.2024 at about 10:20 A.M., the informant along with her daughter went for bringing fire wood near a temple, where 4-5 persons came on a white coloured Scorpio vehicle and forcibly got her daughter seated in the said vehicle and proceeded towards Motipur, out of whom three persons were identified as Sanjeet Raj @ Nunu Ram, Shatrudhan Ram (petitioner) and Rajesh
Patna High Court CR. MISC. No.74196 of 2024(4) dt.21-03-2025 2/3 Prasad. The informant further alleged that three days prior to the occurrence, Rajesh Prasad and Manju Devi, who run a tea-stall in front of the said temple had threatened to get her daughter abducted.

It has been argued by the learned counsel for the petitioner that during course of investigation the victim was recovered and she has given her statement under Sections 161 and 164 Cr.P.C. and in her statement under Section 161 Cr.P.C. she has stated that her mother has beaten her due to which she came to Kali Mandir from where she went to Muzaffarpur in an auto and started living at Muzaffarpur. When a villager told her that her mother has filed a case, she came. In her statement under Section 164 Cr.P.C. she has stated that the petitioner and Sanjeet Raj boarded her in a vehicle and she has also stated that both have done galat kaam with her and left her near village temple. She has further stated that she was having friendship with Sanjeet. In this case the victim has denied the medical test/examination. Admittedly, the victim was having friendship with Sanjeet, her statement under Sections 161 and 164 Cr.P.C. are contradictory. The petitioner is in custody since 24.07.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kanti P.S. Case No. 268 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Muzaffarpur (West).
