In this case, the petitioner is seeking anticipatory bail in connection with Manjhagarh P.S. case No.175 of 2017, registered for the offence punishable under Sections 147, 148, 341, 323, 324, 325, 307 and 448 of the Indian Penal Code, pending in the court of C.J.M., Gopalganj.

Allegation has been made that the accused persons including the petitioner came to the khalihan of the informant, hot discussion took place. Thereafter Aftab Alam has caused injury on the head of the informant. On raising alarm, the family of the informant arrived there and they were also assaulted by the accused persons, in which the son and wife of the informant

Patna High Court Cr.Misc. No.6037 of 2018(2) dt.02-02-2018 2/2 received grievous injury on different part of the body. As there is involvement of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the court below and pray for regular bail, the court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
