JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2017 Heard Sri Sheo Kumar Prasad, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in Nawada Town P.S. Case No. 706 of 2016, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 has prayed for grant of bail in the event of arrest or surrender primarily on the ground that he is the registered owner of the vehicle i.e. Bolero , from which huge quantity of country made liquor was shown recovered. He submits that the vehicle was being driven by the driver of the petitioner and petitioner was not at all aware regarding carrying of the vehicle in question and only on the ground that petitioner is vehicle owner and during investigation this fact has come , the petitioner has been made

Considering the fact that petitioner was owner of the vehicle only and submission of learned counsel for the petitioner that owner was not aware about carrying of country made liquor by the vehicle, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Shailendra Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada / concerned court in connection with Nawada Town P.S. Case No. 706 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973. (Rakesh Kumar, J) Praful/- U T
