The petitioner seeks regular bail in connection with Amarpur (Fulli Dumar) P.S.Case No.474 of 2016 corresponding to G.R.No.3317 of 2016, registered for offences punishable under Sections 147, 148, 149, 302 & 307 of the Indian Penal Code and Section 27 of the Arms Act and 3⁄4 of Explosive Substance Act. Allegation is against this petitioner and 17 other accused persons of firing and exploding bomb.
It is submitted on behalf of the petitioner that identification of the petitioner among 17 persons is doubtful, further no specific allegation has been attributed against him and he is in custody for more than 1 1⁄2 months. It is also submitted that the other accused persons, having similar allegation, have already been granted bail
Patna High Court Cr.Misc. No.23584 of 2017 (2) dt.19-05-2017 2/3 by this Court, vide order dated 19.4.2017 passed in Cr. Misc. No. 13037 of 2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, as well as the petitioner has no criminal antecedent, as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Banka in connection with Amarpur (Fulli dumar) P.S.Case No.474 of 2016 corresponding to G.R.No.3317 of 2016.
With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
