This is an application for grant of anticipatory bail in connection with Parbatta P.S. Case No. 190 of 2017 registered for the offence punishable under Sections 452, 384 and 380 of the Indian Penal Code.
The case of the prosecution is regarding one Naresh Yadav having informed the informant on telephone that the accused persons had broken the lock of the house of the informant and committed theft. Thereafter, the informant is said to have come to his house when he was threatened by the accused persons. The learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.8288 of 2018(3) dt.03-04-2018 2/2 F.I.R. has been filed belatedly after 15 days of the alleged occurrence and admittedly, a land dispute is going on between the parties. It is further submitted that the petitioners are having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Khagaria in connection with Parbatta P.S. Case No. 190 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) ajay gupta/- U T
