1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehends their arrest in a case registered for the offences punishable under Sections 319 (2), 318 (4), 338, 336 (3), 3(5) of B.N.S.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the dispute is civil in nature to which a criminal colour has been given. It is furhter submitted that the informant is claiming that the land in dispute belongs to him while Hemraj claimed that he purchased the land from Nawal

No.70241 of 2025(2) dt.14-10-2025 2/3 Sah in the year 1997 and in pursuance whereof Jamabandi in the name of Hemraj was created, the petitioner no.2 is purchaser of the land in dispute from Hemraj, it is further submitted that as far as petitioner no.1 is concerned, against him it is alleged that he looted the wheat crop of the informant from the land in dispute. It is next submitted that Hemraj Singh @ Hamraj Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.58917/2025 and the same was allowed by an order dated 13.10.2025 after considering the case on merits and in detail. It is thus submitted that petitioners based on parity be granted the privilege of anticipatory bail.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the order dated 13.10.2025 in Cr. Misc. No.58917/2025, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection
