Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353, 323, 120(B) of the Indian Penal Code, Sections 25(1b)A/26/27/35 of the Arms Act, Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Submission is that nothing was recovered from possession of the petitioner and name of the petitioner surfaced in the confessional statement of co-accused Neeraj Kumar. Petitioner has got identical criminal cases against him. Considering the facts aforesaid, let the petitioner, above named, be released on bail, after framing of the charges against the petitioner, on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.65582 of 2019(2) dt.04-11-2019 2/2 each to the satisfaction of learned Court below where the case is pending in connection with Barh Police Station Case No. 163 of 2019 corresponding to Special Case No. 3438 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
