The petitioners apprehend their arrest in connection with N.T.P.C. P.S. Case No.26 of 2019 registered under Sections 498(A), 354 and 376/34 of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act.

The accusation is that before eight years, the informant, due to illness of her sister, went at the sasural village of her sister to help her, where Manish Kumar, the brother-inlaw of the sister of the informant, used to eve-tease her, due to that reason, she was sent to her parental house. Thereafter,

No.64058 of 2019(2) dt.18-10-2019 2/3 Manish Kumar started to visit the parental house of the informant and, in that course, love affair started in between the informant and Manish Kumar. Manish Kumar also gave assurance to the informant to perform the marriage with her and on the assurance of marriage, Manish Kumar developed physical relation with the informant. When the informant made proposal before Manish Kumar to perform the marriage, then he demanded cash Rs.2,50,000/-, gold ring and Apachi Motorcycle but the mother of the informant was unable to fulfill the aforesaid demand. Thereafter, when the matter was reported to these petitioners, they supported the demand made by Manish Kumar and also told that if the aforesaid demand is not fulfilled, her marriage would not be performed.

Learned counsel for the petitioners submits that the petitioner no.1 is brother, petitioner no.2 is cousin brother and the petitioner no.3 is the father of Manish Kumar and they have falsely been implicated in this case by the informant only to put pressure upon them so that they may compel Manish Kumar to get the marriage performed with her.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be

P.S. Case No.26 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
