2. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 103, 61(2) and 3(5) of the BNS and Section 27 of the Arms Act.
3. As per F.I.R., there is allegation against coaccused Bhola Singh that he fired upon the son of the informant due to which he died. It is alleged that petitioners were seen along with the co-accused Bhola Singh.
4. It is submitted on behalf of the petitioners that petitioner is innocent and have committed no offence as alleged. Specific allegation of firing is against co-accused Bhola Singh
Patna High Court CR. MISC. No.75185 of 2025(2) dt.18-11-2025 2/2 and petitioners are only alleged to be present at the place of the occurrence. No specific accusation or overt act has been alleged against these petitioners.
5. Learned counsel for the State opposes the bail petition.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., VI, Sitamarhi in connection with Riga P.S. Case No. 328 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS), 2023. (Prabhat Kumar Singh, J) AjayMishra/- U T
