2. The petitioners are apprehending arrest in connection with Shivsagar P.S. Case No. 30 of 2024, registered on 21.01.2024 for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against ten named accused persons including the present petitioners. It is alleged that petitioner No. 1 put pistol on the head of the informant, and the other accused persons assaulted him.

4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that from the contents of the FIR, it becomes crystal clear that there is no allegation of any act or overt act against petitioner No. 1 and as for petitioner Nos. 2 and 3, there is absolutely nothing save and except that they were allegedly members of the mob. Counsel further submits that it is evident from the FIR that the petitioners and the informant belong to the same village and same Police Station, are well-known to each other, and that the cause of the dispute is clearly mentioned in the FIR. The dispute arose due to a scuffle between the children of the accused persons, leading to the present case.
Counsel for the petitioners further submits that, for the same date and place of occurrence, there are case and counter-case, one case was lodged from the informant's side, i.e., Shivsagar P.S. Case No. 30 of 2024 and another case was lodged from the petitioners' side, i.e., Shivsagar P.S. Case No. 31 of 2024. Counsel further submits that both the petitioners and the informant have no criminal antecedents but under sudden anger, this case has arisen.
5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the Trial Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas in connection with Shivsagar P.S. Case No. 30 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
