The petitioner apprehends his arrest in connection with Sandesh P.S. Case No.86 of 2019 registered under Sections 302 and 120(B) of the Indian Penal Code.

The accusation is that the informant performed the marriage of his daughter Sunita Devi in the year 2002 with the petitioner Indrajeet alias Bigan Singh, resident villageSurangpur, P.S. Sandesh, District-Bhojpur. On 03.05.2019, the daughter of the informant talked to him saying to come very soon otherwise she will be killed under conspiracy by her inlaws. When the informant reached at the house of his daughter, he was informed that his daughter died. On seeing the dead

Patna High Court CR. MISC. No.73267 of 2019(3) dt.04-02-2020 2/3 body, the informant found the face of his daughter bluish in colour. The husband of the daughter of the informant (petitioner) is in army, who had come on leave at the house. Learned counsel for the petitioner submits that, admittedly, the petitioner is the husband of the daughter of the informant. At the time of the occurrence, the petitioner was posted at Ahmedabad and on receiving the information regarding the death of his wife, the petitioner moved from Ahmedabad taking the flight on 03.05.2019 and reached in the morning of 04.05.2019 to his house. With an ulterior motive, the petitioner has also been implicated in this case. In fact, the wife of the petitioner died due to reaction of the medicine. After knowing the real fact, the informant has filed a compromise petition in the court of the Judicial Magistrate, First Class, Ara, Bhojpur, which would appear from Annexure-3 to this application.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur
