====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 09-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dalsingsarai P.S. Case No.39 of 2017 registered under Sections 8/20(C)/25 N.D.P.S. Act.

The accusation is that on receiving secret information about transporting of 'Ganja', at the truck bearing Registration No.TR-01-S/1717 escorted by a white colour Bolero vehicle, the informant being the Officer Incharge of Dalsingsarai Police Station alongwith other police officials reached at Dhepura on road then the aforesaid truck escorted by Bolero vehicle bearing Registration No.BR-01-PB/8098 was seen coming. No.24654 of 2017 (6) dt.09-11-2017 2/3 seeing them, the persons sitting on the truck and Bolero vehicle tried to flee away, leaving the truck and Bolero vehicle, but Sikandar Rai, Nirmal Baunik and Rahul Deo, who were sitting on the truck, were apprehended and, on search, 720 kilogram Ganja, kept in 72 pockets, each containing 10 kilogram, was recovered from the truck. Three persons, namely, Ashok Kumar, Shailesh Prasad and Brajesh Kumar, who were sitting on the Bolero vehicle, were also apprehended and, on search, 50 kilogram Ganja, kept in 10 packets, each containing 5 kilogram Ganja, was recovered from the Bolero vehicle.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the owner of the Bolero vehicle bearing Registration No. BR-01-PB/8098, which was being driven by the Driver Brajesh Kumar at the time of the occurrence. In fact, Ashok Kumar hired the aforesaid Bolero vehicle of the petitioner and used the same for carrying the Narcotics behind the petitioner. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court Cr.Misc. No.24654 of 2017 (6) dt.09-11-2017 3/3 with two sureties of the like amount each to the satisfaction of the Sessions Judge, Samastipur, in connection with Dalsingsarai P.S. Case No.39 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
