JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-02-2018 This application under Section 482 of the Code of Criminal Procedure has been filed by the petitioners seeking correction in father's name and residential address of petitioner no.7 mentioned in the judgment dated 23.01.2018 passed by this Court in Cr. Misc. No.38788 of 2016.
It is submitted by the learned counsel for the petitioners that father's name of petitioner no.7 is Rampravesh Sah and he is resident of village Rupnagar, P.S.-Barauni, District- Begusarai, but, due to inadvertence, in the petition filed before this Court in the cause title, the father's name and address of petitioner no.7 were wrongly typed as Ramballi Sah, resident of villageRechayahi, P.S.-Matihani, District- Begusarai as a consequence thereof in the cause title of the aforesaid judgment dated 23.01.2018 father's name and address of petitioner no.7 were given as Ramballi Sah, resident of village-Rechayahi, P.S.- Matihani, District- Begusarai.
It is contended that the error in typing in the petition was neither deliberate nor willful. The correction could not be made by the counsel after the petition was typed due to inadvertence and if
Patna High Court Cr.Misc. No.8882 of 2018 (2) dt.19-02-2018 3/3 the same is not condoned and the father's name and the address are not corrected irreparable loss would be caused to the petitioner no.7.
Learned counsel for the State does not oppose the prayer made on behalf of the petitioners.
Considering the facts and circumstances of the case, in the cause title of the judgment dated 23.01.2018 passed in Cr. Misc. No.38788 of 2016 father's name and residential address of petitioner no.7 be read as Rampravesh Sah, resident of villageRupnagar, P.S.-Barauni, District- Begusarai. In view of the above correction, the period of surrender stipulated in the judgment dated 23.01.2018 passed in Cr. Misc. No.38788 of 2016 is extended by further ten days as far as petitioner no.7 is concerned.
