2. The petitioner has preferred this application for grant of regular bail in connection with Fatuha P.S. Case No. 532 of 2023 registered for the offences punishable under Section 304(B) read with Section 34 of the I.P.C.
3. As per the prosecution case, the petitioner and the other co-accused persons are alleged to have tortured the informant's sister mentally and physically due to non-fulfillment of demand of Rs. 1,00,000/- as dowry. It is further alleged that on 14.07.2023, the informant got an information that the accused persons had committed murder of his sister by pressing
Patna High Court CR. MISC. No.72165 of 2025(2) dt.10-11-2025 2/3 her neck. The informant rushed to the matrimonial house of his sister where he saw her dead body, kept in the room.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner is the brotherin-law (Bhaisur) of the deceased and he neither demanded any dowry nor tortured the deceased. Similarly situated co-accused person, namely, Ramesh Singh (husband of the deceased) has already been granted bail by a Co-ordinate Bench of this Court vide order dated 30.09.2024 passed in Cr. Misc. No. 67954 of 2024. The petitioner has clean criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 05.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna, in connection with Fatuha P.S. Case No. 532 of 2023.
