1. Heard the learned counsel for the appellants and the learned Special Public Prosecutor for the State.
2. The appellants have challenged the order dated 17.08.2024 passed by the learned Additional District & Sessions Judge, First, Madhubani in connection with ABP No.1593 of 2024 arising out of Andhramath P. S. Case No.180 of 2023 instituted for the offences under Sections 147, 148, 149, 186, 341, 323, 331, 332, 337, 338, 353, 504 and 506 of the Indian Penal Code and Section 3(i)(r)(s) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act and Section 45
Patna High Court CR. APP (SJ) No.4745 of 2024(3) dt.10-01-2025 2/3 of the Bihar Prohibition and Excise Act, whereby their prayer for grant of anticipatory bail has been rejected.
3. The the learned counsel appearing on behalf of the appellants submits that appellant no.1 has antecedent of one case while rest of the appellants are persons with clean antecedent. It is next submitted that Saurabh Singh had approached this Court seeking anticipatory bail by filing Cr. Appeal (SJ) No.3495 of 2024 and the same was allowed by an order dated 07.10.2024. It is next submitted that the case of the appellants are similar to the case of Saurabh Singh. It is further submitted that specific allegation of assaulting the informant is against Malkhan Singh @ Suman Singh.
4. Regard being had to the aforesaid submissions, the order dated 17.08.2024 is set-aside.
5. The appeal stands allowed.
6. The appellants, above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, First, Madhubani in connection with ABP No.1593 of
Patna High Court CR. APP (SJ) No.4745 of 2024(3) dt.10-01-2025 3/3 2024 arising out of Andhramath P. S. Case No.180 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
