Petitioner is accused in connection with Kanti P.S. Case No. 597 of 2018 registered under Sections 363/366(A)/34 of the I.P.C.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. On perusal of the order of learned Additional Sessions Judge-I, Muzaffarpur, it appears that the Medical Board has assessed the age of the victim as 16-17 years. The victim, in her statement recorded under section 164 Cr. P.C., clearly stated that on 17.09.2018, she came out from her residence and started to live with petitioner in a rental house and on 05.10.2018,

Patna High Court CR. MISC. No.67029 of 2019(2) dt.14-11-2019 2/2 solemnized marriage with him. Further she stated that she does not want to live with her parents. The members of in-laws family treated her in a good manner. It is also submitted that petitioner is in custody since 05.08.2019, having no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Muzaffarpur in connection with Kanti P.S. Case No. 597 of 2018.
