JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 32 of 2019 registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. As per FIR there is allegation of demand of Rs.5.5 lac and one motorcycle and for that the informant was tortured and assaulted and petitioner is said to be husband of the informant. Submission of learned counsel for the petitioner is that he has falsely been implicated and he is still ready to keep the informant with him with dignity and care. Heard learned APP also.

In view of above facts and circumstances, this

Patna High Court CR. MISC. No.64599 of 2019(2) dt.16-10-2019 2/2 application is disposed of with direction to the petitioner to surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on provisional bail for a period of six months by the court below itself and during that period the court below shall issue notice to the informant and once she has appeared, the matter shall be referred to the District Mediation Centre in order to see that there is any chance of settlement between the parties and once the report of Mediator is received and considering the conduct of the parties, the court below shall pass an appropriate order confirming the bail bonds of the petitioner. It is made clear that after issuance of notice if informant has not appeared in the court below, the petitioner shall be released on bail to its own satisfaction. (Vinod Kumar Sinha, J) spal/- U T
