2. The petitioner apprehends his arrest in Hajipur Excise P.S. Case No. 259 of 2023 registered for the offences punishable under Sections 30(a)(b)(c), 32(1)(2)(3) and 41(1)(2) of the Bihar Prohibition and Excise Act, pending in the Court of learned Exclusive Special Excise Court No. II-cum-Additional District and Sessions Judge, Vaishali at Hajipur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.73304 of 2023(2) dt.01-12-2023 2/2 learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that the petitioner has no criminal antecedent.
