The petitioners apprehend their arrest in Govindganj P.S. Case No.267 of 2016 registered under Sections 147, 148, 323, 324, 448, 379, 380 and 504 of the Indian Penal Code. The informant, Jawahar Lal Giri named the petitioners along with other accused persons and alleged that Parmeshwar Giri assaulted the informant with farsa but in the meantime, his son Upendra Giri caught Parmeshwar Giri but the petitioner, Shardanand Giri spear in the leg of Upendra Giri. It is further alleged that the accused persons assaulted the informant and others and took away different articles.

Mr. Umakant Shukla, the learned counsel for the

Patna High Court Cr.Misc. No.17706 of 2018 (2) dt.05-04-2018 petitioners submits that there is a counter version being Govindganj P.S. Case No.268 of 2016. Petitioner No.1 is the informant of the counter case. Upendra Giri got simple injury on his leg on account of assault made by the petitioner. There is no repetition of blow. It is further submitted that from the side of the petitioners, many persons were injured.

Considering the facts aforesaid, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Govindganj P.S. Case No.267 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
