JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Petitioner apprehends his arrest in connection with Hajipur Town P.S.Case No. 647 of 2011 registered under Sections 420, 406 and 120B of the Indian Penal Code.
Allegation against the petitioner is of committing fraud upon the informant as he has taken Rs.1 lac for providing job to the son of informant.
Submission of learned counsel for the petitioner is that the whole allegation is false and concocted because of the fact that petitioner has got married his son with a lady and thereafter his son divorced his wife and informant is relative of the daughter-inlaw of the petitioner. Further submission is that the case has been compromised between the parties.
Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.10687 of 2018 (2) dt.28-02-2018 2/2 anticipatory bail stating that the case is of the year 2011 and till date he has not surrendered.
Having heard both sides and in view of facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. He is directed to surrender within a period of six weeks and pray for regular bail, which shall be considered on its own merit and also on the submission that the case has been compromised, without being prejudiced by this order. With the above observation, this application is disposed of.
