The petitioner apprehends his arrest in connection with Triveniganj P.S. Case No. 249 of 2014 registered under Sections 147, 148, 149, 323, 324, 325, 307, 337, 452, 427, 435, 436 and 379 of the I.P.C. pending in the Court of A.C.J.M.-I, Supaul.
Submission of learned counsel for the petitioner is that earlier prayer of the petitioner for anticipatory bail was rejected by this Court vide Cr. Misc. No. 37829 of 2017 on 21.09.2017. Further it is submitted that there is direct allegation of causing grievous injuries against the petitioner is quite wrong
Patna High Court CR. MISC. No.71957 of 2019(3) dt.19-02-2020 2/2 because the injury is suspected, manipulated and concocted. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that vide order dated 21.09.2017 bail application of the petitioner was rejected by this Court after considering the merit of the case. Further he submits that after lapse of more than two years of the rejection order of the bail application, the petitioner has not surrendered before the Trial Court. Therefore, his prayer for grant of anticipatory bail may be rejected.
Having considered the facts and circumstances of the case and the submissions advanced on behalf of the State, prayer for bail of the petitioner is rejected. However, petitioner is directed to surrender before the Trial Court within a period of two weeks from today. (Arvind Srivastava, J) shailendra/- U T
