The petitioner apprehends his arrest in connection with Bihiya P.S. Case No. 427 of 2018 registered for the offences punishable under sections 341, 323, 307, 379, 354 (A), 504, 506/34 of the Indian Penal Code.

The informant, Nand Kishore Mahto lodged FIR stating therein that there was scuffle between the children. When the informant's brother, namely, Awadh Mahto went to pacify the matter then co-accused Laloo Yadav with other accused persons abused and assaulted him. On hearing hue and cry, when the informant and his wife Urmila Devi, daughter Naina Kumari and nephew Kamlesh Mahto came there to rescue him, they were also assaulted by the petitioner. Allegation against the petitioner is also that he inflicted rod blow on the head of Kashi Mahto, elder brother of the informant. Learned counsel for the petitioners has submitted that there

The injury report of Kashi Nath Mahto is annexed with the record. Three injuries are found on his person. One is lacerated wound 3/4" x 1/4" x scalp deep on right side of forehead. The second injury is diffuse swelling and tenderness of right forearm and the third injury is diffuse swelling of left thigh. All injuries caused by hard and blunt substance. The injury report does not contain any opinion of the doctor about the nature of the injury. Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender, within six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Ara in connection with Bihiya P.S.
