The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code pending in the learned court below. Allegation against the petitioner is that he along with other unknown person of the age group of 25-26 years with faces covered with masks entered into the centre, and on the point of pistol looted away Rs.1,12,535/- and laptop bag containing documents relating to U.T.I. and L.I.C. and fled away on their Apache/Pulsar motorcycle without registration number. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Patna High Court CR. MISC. No.71772 of 2022(2) dt.16-03-2023 2/2 case. He further submits that the alleged does not belongs to the petitioner. He submits that the petitioner is made accused on the basis of the confessional statement of the co-accused. He further submits that petitioner has got one criminal antecedent as stated in para-3 of the bail application.

Per contra, learned APP for the State vehemently opposing the bail application and submitted that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.

Considering the nature of the offence, I am not inclined to enlarge the petitioner on bail in connection with Chanpatia P.S. Case No. 249/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
