JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-04-2018 The petitioner is apprehending his arrest in connection with Kotwali (Purabsarai) P.S. Case No. 320 of 2017, registered for offences punishable under Section 379 of the Indian Penal Code.

Allegation is of commission of theft of motorcycle. It has been submitted on behalf of the petitioner he has not been named in the F.I.R and nothing has been recovered from him and his name has surfaced on disclosure of other co-accused. He has been made accused in connection with a case of Arms Act but he has been granted the privilege of anticipatory bail in that case from the court below itself.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.13603 of 2018 (2) dt.06-04-2018 2/2 circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and pray for regular bail and if any such application is filed, the court below shall consider the submission of petitioner and also that other co-accused of this case has already been granted the privilege of anticipatory bail and shall pass an appropriate order on the same day, without being prejudiced by the order of this Court.
