1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the allegation against the petitioner in the instant F.I.R. is that he sought appointment as a Teacher based on forged and fabricated certificates.
4. The learned counsel for the petitioner submits that the instant F.I.R. came to be instituted based on an inquiry conducted behind the back of the petitioner. It is further
Patna High Court CR. MISC. No.74910 of 2023(3) dt.19-02-2024 2/2 submitted that had an opportunity been given to the petitioner to explain his case, perhaps the F.I.R. would not have been instituted. It is next submitted that petitioner will not abscond rather will cooperate in the investigation.
5. Learned Additional P. P. opposes the bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera, Samastipur in connection with Bibhutipur P. S. Case No.365 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
