2. The petitioner seeks bail in connection with Azamnagar (Salmari O.P.) P.S. Case No. 274 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. About 4 litres of illicit liquor has been recovered from the plastic bag.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 31.07.2023.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.74333 of 2023(2) dt.29-11-2023 2/2 prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, Exclusive Special Excise Court No.-II, Katihar in connection with Azamnagar (Salmari O.P.) P.S. Case No. 274 of 2023.

7. The petitioner will also mark attendance in Azamnagar (Salmari O.P.) Police Station, Katihar on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
