JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Shri Binit Kumar, learned counsel for the petitioner and Shri Madan Kumar, learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in Laheri P.S. Case No. 39 of 2017 registered for the offence under Sections 420, 467, 468, 406 , 34 of the Indian Penal Code , 1860 has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that initially a complaint petition was filed by none else but own brother- inlaw of the petitioner which was numbered as Complaint Case No. 1117 of 2016 however the complaint case was referred to Police under Section 156(3) of the Cr.P.C. for registering FIR and investigating the case. Thereafter, the present FIR was lodged. He further submits that in the so-called misappropriation which occurred long back in the year 2001 the

Patna High Court Cr.Misc. No.6761 of 2018(2) dt.12-02-2018 2/2 complaint petition was filed in the year 2016. Besides hearing learned counsel for the parties I have also perused the materials available on record and after going through the complaint petition which is the basis of the FIR, I am of the opinion that it is a fit case for grant of anticipatory bail. Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Bipendra Prasad @ Bikku be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif / concerned court in connection with Laheri P.S. Case No. 39 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
