14-06-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned Additional Public Prosecutor for the State.

Petitioner is seeking regular bail in connection with Kadirganj P.S. Case No. 98/2016 registered for the offence punishable under Sections 304(B), 201, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the husband of sister-in-law of the deceased and is in jail since 20.02.2017. The husband of the deceased has already surrendered and is in jail presently.

Learned counsel for the petitioner further submits that the entire family of the husband including the

Patna High Court Cr.Misc. No.25749 of 2017 (2) dt.14-06-2017 present petitioner who has nothing to do with the family of the husband of the deceased either in mess or business has been falsely implicated.

Learned counsel for the informant opposed the prayer for bail of the petitioner and submitted that it is a case in which the dead body of the deceased was also not found.

Considering the fact that the petitioner is the husband of sister-in-law of the deceased and is in jail for more than three months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Masaurhi, district - Patna, in connection with Kadirganj P.S.
