====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Sections 22 and 24 of the NDPS Act and Sections 30(a) and 37(b) of the Excise Act. Petitioner is in custody since 12.11.2017.

2.84 Kg of ganja and 3.600 litres of Nepali liquor was recovered from the possession of the petitioner. In the past, twice prayer for bail was refused vide orders at Annexure-1 and Annexure-2.

Submission is that the trial is going on and the petitioner is ready to cooperate with the trial. Petitioner has stated on oath that he has got no criminal antecedent. Considering the submission aforesaid and the period

No.74964 of 2019(2) dt.05-03-2020 2/2 already undergone by the petitioner as under trial prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with N.D.P.S. Case No. 87 of 2017 (Palanwa (Belahi O.P.) P.S. Case No. 144 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
