JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-07-2023 At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 01.10.2021 passed by the Circle Officer, Keshariya, District-East Champaran in connection with Encroachment Case No. 7 of 2020-21 by filing appropriate appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956. Liberty so sought is granted.
It is needless to state that in case
Patna High Court CWJC No.18471 of 2022(2) dt.03-07-2023 2/2 appropriate appeal is filed within a period of four weeks from today, the same shall be heard on merits by the appellate authority, without being impeded by the issue of limitation and a reasoned and a speaking order shall be passed thereon, in accordance with law, within a period of eight weeks, thereafter and till then status quo existing as on today qua the house of the petitioner in question shall be maintained.
The writ petition stands disposed off on the aforesaid terms.
