JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 The petitioner seeks regular bail in connection with Buxar (M) P.S. Case No. 100 of 2019, registered for offences punishable under Sections 302, 379/34 of the Indian Penal Code and later on added Section 27 of the Arms Act. Prosecution case is that son of the informant was shot dead by some miscreants and the F.I.R. was lodged against unknown. Later on name of the petitioner transpired on confession of two co-accused persons. Apart from that petitioner is accused in three more cases.

It has been submitted on behalf of the petitioner that so far this case is concerned, save and except confessional statement of co-accused, there is absolutely nothing against the petitioner and he has been custody for more than five months no specific allegation has been attributed to the petitioner.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (M) P.S. Case No. 100 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds as well as subject to the condition that petitioner after his release has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of nine months so that the police may watch his conduct during that period.
