2. This application has been filed against the order dated 21.06.2023 passed by the learned Additional Sessions Judge-cum-Special Judge, Biharsharif, Nalanda in Children Case No. 7 of 2022 arising out of Ben P.S. Case No. 60 of 2022 registered for the offence under Section 377 of the Indian Penal Code and under Section 4/6 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of committing rape upon an eight year old minor girl.

4. The age of the petitioner on the date of occurrence is assessed to be 16 years and 10 months.

5. Though, the petitioner is held to be juvenile but in view of the serious allegation levelled against him this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

7. If no assessment has been done by the Juvenile Justice Board under Section 15 of Juvenile Justice (Care and Protection of Children) Act, 2015 the same shall be done and the petitioner shall be tried in accordance with law. (Sandeep Kumar, J) Vikas/- U T
