JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Tariyani P.S. Case No. 104 of 2019 registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code.

As per FIR prosecution case is that there was defalcation of altogether Rs.15,48,000/-, which was sanctioned for construction of toilet and it is alleged that there was wrong entry made by the petitioner in the 51 allottees and thereby caused loss to the Government money.

Submission of learned counsel for the petitioner is that the matter was inquired into and Block Co-ordinator has submitted a report which disclosed that one Vijay Kumar, Assistant is responsible for the same as 34 allottees are either related to him or of his caste persons, which shows false

It is further submitted that material collected in the case diary disclosed out of the said amount more than Rs.11 lac has been deposited in the Government account and petitioner is ready to co-operate in depositing rest of the amount. Heard learned APP also.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Tariyani P.S. Case No. 104 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he is to co-operate the authority concerned for realising the amount.
