The petitioner seeks bail in a case registered under Sections 341, 342, 147, 148, 149, 323, 307, 379, 384 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons assaulted the informant by means of lathi, danda, butt of rifle, due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.04.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. None is said to have been injured in course of occurrence. No offence under Section 307 of the I.P.C.

Patna High Court CR. MISC. No.67642 of 2019(2) dt.23-10-2019 2/2 is made out. Due to previous enmity the petitioner has been made accused in this case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Khodabandpur P.S. case No.50 of 2019.
