The petitioner seeks bail in connection with Nawada Town P.S. Case No. 200 of 2017, registered under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 153(A) and 427 of the Indian Penal Code, Section 27 of Arms Act and Section 3/4 of Explosive Substance Act.
The accusation is that on 05.04.2017 on the occasion of procession of Mahabiri flag through Kali road, Nawada people of two community started pelting stones. The Police intervened in the matter and at that time 18 persons, who belongs to Mohamandan community, and 9 persons, who belongs to Hindu community, were identified in the mob, who have been pelting stones to each other.

No.28097 of 2017 (2) dt.22-06-2017 2/2 Learned counsel for the petitioner submits that petitioner is named in the F.I.R., but no specific overt act has been attributed against the petitioner. Further submission is that similarly situated co-accused, Ajay Kumar Verma @ Ajay Verma, Gautam Kumar and Pankaj Kumar have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 29.05.2017, 30.05.2017 and 06.06.2017 passed in Criminal Misc. Nos. 23307 of 2017, 24553 of 2017 and 25354 of 2017, respectively. Further submission is that petitioner has no criminal antecedent is in custody since 06.04.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S.
