The petitioner apprehends his arrest in Complaint Case No.1946 of 2011, Tr. No.518 of 2017 registered under Sections 323, 325, 354, 380 of the Indian Penal Code.

The learned counsel for the petitioner submits that only allegation against the petitioner that he took away water pot but it appears from perusal of the order of the learned Sessions Judge that process under Sections 82 and 83 Cr.P.C. have already been issued against the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

Patna High Court Cr.Misc. No.18057 of 2018 (2) dt.09-04-2018 If the petitioner surrenders in the court below, the learned court below shall consider the regular bail of the petitioner taking into consideration the nature of allegation and dispose of the petition of the petitioner preferably on the same day.
