The petitioner seeks regular bail in connection with Aamash PS case no. 61 of 2017 registered for the offences punishable under Sections 272, 273/34 of Indian Penal Code and Section 30(A) of Bihar Excise (Amendment) Act, 2016. The allegation is with regard to recovery of about 17 litres of illicit liquor which was being carried by the petitioner and one another accused person.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.03.2017. It is further submitted that similarly situated accused namely Ajay Kumar Gupta has already been granted bail by this Hon'ble Court vide order dated 19.06.2017 passed in Cr.Misc. no.

Patna High Court Cr.Misc. No.29105 of 2017 (2) dt.01-07-2017 2/2 24007 of 2017.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, J.M. 1st class, Sherghati (Gaya) in connection with Aamash PS case no. 61 of 2017.
