This is an application for grant of anticipatory bail in connection with Samastipur Mufassil P.S. Case No. 708 of 2017 registered for offences punishable under Section 414 of the Indian Penal and Section 40 of the Bihar Mines Mineral Concession Rules, 1972.
The allegation is regarding seizure of sand and mud loaded tractor and the allegation is that the same has caused a loss of Rs. One lakh to the Government.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the tractor has been seized on account of misunderstanding. It is submitted

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Samastipur in connection with Samastipur Mufassil P.S. Case No. 708 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
