JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Khiri More P. S. Case No. 58 of 2018, disclosing offences under Sections 363 and 366A of IPC. As per F.I.R. the daughter of the informant was kidnapped. F.I.R. was lodged against unknown. It appears that after one year, the statement of the the victim girl has been recovered under Section 164 of Cr.P.C., in which she has named the petitioners, as the persons who were instrumental in taking her to Mumbai on the point of knife and she has recovered by the police from Children Home of Mumbai.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case, as the

Having heard both sides, in view of the statement under Section 164 Cr.P.C., I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
