====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-05-2023 Heard the parties.

The petitioners apprehend their arrest in a case registered for the offence punishable u/s 420 of the IPC. As per the prosecution case, an amount of Rs.5,57,600/- has been misappropriated by the petitioners from the informant on the pretext of getting Government job but neither the job was given nor her money was returned. It is submitted by learned Senior Counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case ulterior motive. Patna High Court CR. MISC. No.70126 of 2022(5) dt.16-05-2023 2/3 as alleged, has ever taken place. The allegation leveled against the petitioners is not specific rather general and omnibus in nature. It is submitted that the petitioners are agreed to return Rs.3,07,600/- to the informant in six installments, which transaction appears to be made in the account of father and brother of the petitioners namely Vipin Das and Dev Kumar. Petitioners have no criminal antecedent. Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail. Having regard to the facts and circumstances of the case and considering that petitioners are ready to return Rs.

3,07,600/- to the informant, let the above named petitioners, be released on provisional bail for a period of eight months from today, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Maheshkhunt P.S. Case No.74 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
