The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a)/36/41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather illicit liquor has been recovered between the house and shop of Prabhu Chaudhary. It is further submitted that the other co-accused in the said case have been granted the privilege of bail in Cr. Misc. No. 11080 of 2019 on 25.02.2019 and Cr. Misc. No. 27268 of 2019 on 22.07.2019. Petitioner is languishing in judicial custody since 23.08.2019.
