The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 210 of 2019 for the offence punishable under Sections 341, 323, 504/34 of the Indian Penal Code and Sections 8 & 12 of the POCSO Act.

The allegation is regarding the petitioner and one other accused person having chased the victim girl, whereafter they are said to have misbehaved with her, however, when the school teachers came there, they fled away.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and is languishing in

Patna High Court CR. MISC. No.66726 of 2019(2) dt.13-01-2020 2/2 custody since 10.08.2019.

Having considered the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the period of incarceration, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-cum- Special Judge, POCSO, Gopalganj in connection with Baikunthpur P.S. Case No. 210 of 2019.
