This is a case registered under Sections 399, 402 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. The allegation made in the FIR is that when the police arrived at the spot, five persons were arrested and four are said to have fled away.
Counsel for the petitioner submits that out of five arrested persons, three have already been granted bail even though against them there was allegation of recovery of arms and cartridges vide order dated 13.01.2017 passed in Cr Misc. No. 52907 of 2016, order dated 26.04.2017 passed in Cr. Misc. No. 14463 of 2017 and order dated 18.03.2017 passed in Cr. Misc. No. 11882 of 2017. He further summits that nothing has been recovered from the possession of the
Patna High Court Cr.Misc. No.30054 of 2017 (2) dt.06-07-2017 2/2 petitioner and he is in custody since 31.12.2016. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Begusarai Town P.S. Case No. 406 of 2016.
